Our platform is specifically designed to connect diners with independent chefs who offer exceptional private chef services. 

We want you to have a seamless experience when using our platform, which is why we have carefully crafted our Terms and Conditions to ensure your safety and satisfaction. Please take a moment to read through them carefully. It's important to note that while we facilitate the connection between diners and chefs, we do not become a party to any contractual relationships.

To get started, all you need to do is register with your email address and agree to our General Conditions of Use. We are excited to help you find the perfect chef for your next culinary adventure!


2. TERMS AND DEFINITIONS
We're excited to provide you with a clear and concise list of important definitions that will help you navigate our platform with ease. 

First and foremost, CGU refers to our current General Terms and Conditions of Use. 

If you're a chef who uses our platform to offer private chef services for a fee agreed upon by both parties, you are considered a "Chef." On the other hand, if you're someone who uses our platform to request a private chef service and eventually contracts the services of a Chef, you are known as a "Diner." 

"Confirmation of the reservation" is a term that refers to a system for the reservation of online services (“Reservation”) through the Platform.


"User-developed content" is content that is created by our users and is defined in Article 11. below. 

An "Account" is necessary to become a user on our platform and access the services offered by other users. 

"Management expenses" refer to expenses related to management and are defined in Article 5. below. 

"Messages" are communications shared between chefs and diners through our platform during the offer process prior to the reservation. 

"Menu" refers to the specific content of the offer that a chef makes to a diner in response to a request registered on our platform. This includes the specific menu proposal and any messages exchanged between the chef and diner in relation to the service offered. 

"Offer" includes the menu and messages exchanged between the chef and diner. It is the content of the provision of services offered independently by the chef to the diner in response to a request. 

A "Chef Profile" is all the information uploaded by a chef to our platform related to their user profile, including text and images. This profile will be visible both in their public chef profile and every time a diner receives an offer from the chef. 

Our "Platform" is the place where all of these services and offers take place. 

The "Price" is the sum of the chef's fee and the management expenses, paid by the diner through our platform to confirm a booking

A "Service" is the object of the contractual relationship between the chef and diner, based on the provision of a gastronomic service specified in an offer, with conditions freely established between the parties.

Finally, a "Request" refers to the request made by a diner for a private chef service through our platform. 

As you can see, we're committed to providing a user-friendly platform that makes it easy for chefs and diners alike to connect and enjoy delicious meals together. We hope these definitions have been helpful and we're excited for you to get started on our platform

3. REGISTRATION AND ACCOUNT CREATION
We value safety and responsibility at our Platform, and for this reason, we have instituted policies that limit registration and use of our services to individuals over the age of 18. We take this policy seriously and strictly prohibit minors from accessing our Platform. We kindly request that you confirm your age as over 18 years old during registration.

To gain access to our Platform, you must first register as either a Chef or a Diner. Before registering, we humbly request that you read and accept our terms and conditions and privacy policy.

We encourage you to provide accurate and truthful information when creating your account, as we are proud to be a community of honest and trustworthy individuals. We rely on the information provided by our members to maintain the integrity of our Platform. We also encourage you to update your profile information as needed.

If you choose to register using your email, we kindly suggest that you keep your password confidential and avoid sharing it with anyone. If you suspect that your password has been compromised, please contact us immediately. Please note that you are solely responsible for any activity that takes place on your account, except where we have been notified of any unauthorized use.

Creating multiple accounts is prohibited. Each User should have only one account created under their name to ensure that our community is made up of genuine individuals who are passionate about food and cooking.

Lastly, for security and transparency, we may need to verify certain information in your profile. This may include verifying your phone number or identity. It is important to note that any references to certified information on our Platform indicate that a User has successfully completed our verification process. While we cannot guarantee the accuracy of this information, we endeavor to maintain a safe and reliable community.

4. USE OF SERVICES

- Diners can request a Service through the Platform by registering as a User.
- Chefs can offer private chef services to Diners who register a request in their area, provided they meet the established conditions. Explained in Article 4.1 Below
- You can book a service through TwoTooAte by submitting a Request on the Platform and paying the full amount set by the Chef. Explained in Article 4.2 Below
- Any use of the Platform must correspond to the identity communicated by you to TwoTooAte. Explained in Article 4.3 Below
- TwoTooAte encourages Diners to share their opinions about a Chef after enjoying a Service contracted through the Platform.
-Chefs are evaluated Explained in Article 4.4 Below
- TwoTooAte may not publish or may remove any evaluation that violates the CGU. 

4.1 .PREREQUISITES FOR CHEFS
 Firstly, we would like to confirm that you meet the legal age requirement. Secondly, we're looking for seasoned culinary experts with at least five years of professional experience as a cook. Our clients deserve the finest, and we're committed to providing them with nothing less.

Furthermore, we require that you possess all the necessary licenses and certifications that ensure safe food handling practices and proper hygiene and sanitation protocols. At our organization, we take our clients' health and well-being very seriously, and we want our chefs to be suitably equipped to handle these obligations.

In addition, we insist that you comply with all the relevant legal requirements in your area, whether you operate as a freelancer or as part of a company. Our priority is to ensure that everyone involved in the process is protected and follows the law.

We understand that mishaps may occur, so we mandate all our chefs to possess civil liability insurance to safeguard against any potential damages that may arise during the provision of their services. Our aim is to ensure that everyone involved is safeguarded and taken care of.

Transporting food can be challenging, but we need to ensure that all the raw materials you use are transported safely and in compliance with local regulations. We have faith in your ability to take all necessary precautions to ensure that you use the highest quality ingredients and handle them with care.

Finally, it's crucial that you maintain good hygiene and use utensils that are in good condition. We appreciate your dedication and commitment to excellence, and we want to ensure that every aspect of your work meets our standards.

We trust that you will furnish us with accurate and truthful information about your services, and we're confident that you'll do everything possible to provide our clients with an exceptional experience. We're excited to see what you have to offer!


4.2 BOOKING A SERVICE
TwoTooAte allows users to book online services through its platform. To book a service, a diner submits a request, which is forwarded to chefs available in the location set by the diner. At least one chef sends a proposal, and the guest pays the price set by the chef through the platform. TwoTooAte does not intervene in any phase of the reservation process, and both parties confirm each element of the service. Once the reservation is made, both the diner and chef receive an email notification with the other party's contact details for further communication.


4.3 USER IDENTITY
Users must use their own identity when using the platform as a Diner or Chef. It is prohibited to send an offer on behalf of another Chef.


4.4 CHEF EVALUATION
TwoTooAte may suspend or terminate your Chef Account if you receive three or more negative reviews with an average score of 3 or less.


5. FINANCE 
The platform allows users to access and register for free. However, to confirm a reservation, the diner must pay the price set by the chef. The chef is responsible for setting a price that includes taxes and management expenses. When setting the price, the platform will always indicate the percentage corresponding to management expenses, so the chef can set the appropriate price. The chef is responsible for keeping the information of their offer updated at all times and canceling it if it is no longer available.

When a diner reserves a chef's offer, they are entering into a legally binding contract that requires the chef to provide the service under the conditions described in the offer. The chef agrees to pay the corresponding management expenses and applicable taxes. It is recommended that chefs take out adequate insurance for the service provided to the diner.

TwoTooAte charges management fees based on a percentage of the chef's price. The percentage is always visible to the chef when they establish the price of their offer. The management expenses will be charged at the moment of confirming the reservation. TwoTooAte may round up or down the management fee at their sole discretion.

After the diner's reservation, TwoTooAte collects the total amount paid by the diner. The amount corresponding to the chef's fee received by TwoTooAte is deposited in an account dedicated to the payment of chefs' services. None of the aforementioned amounts received by TwoTooAte on behalf of the chef entitle them to the collection of interests.

As a diner, you can book a service through the platform following the corresponding reservation process. Upon receipt of a booking confirmation by email from TwoTooAte, a legally binding contract is formed between the diner and chef, subject to any terms and conditions agreed between the parties. If you book a service on behalf of several people and one of them is a minor, you must declare and guarantee to be legally authorized to act on behalf of the minor. Minors can only participate in a service if they are accompanied by an adult who is responsible for them.

The chef is responsible for generating an invoice to the diner for the total amount paid. TwoTooAte, for its part, will send the chef an invoice for the management costs. TwoTooAte may request invoices from chefs to process specific payments. Chefs undertake to respond with due diligence to any request from TwoTooAte, and in general, to any competent administrative or judicial authority, especially in relation to the prevention of money laundering. Chefs agree to provide, upon request, any evidence of their address and/or identity.

6. CANCELLATION POLICY
We understand that sometimes plans change, and we want to make sure that our guests and chefs are both protected in the event of a cancellation. Here are the refund conditions you can expect:

If the chef cancels the service, you will be refunded in full. We take our commitment to our guests seriously and want to ensure that you have the best experience possible.

If you need to cancel the service, we've outlined the following refund policy:
- If you cancel more than 30 days in advance, you'll receive a full refund of your reservation.
- If you cancel between 14 and 29 days before the scheduled service, you'll receive a 50% refund of the amount paid. Alternatively, you can reschedule your reservation with the same chef within the next 90 days. We want to make sure you have the flexibility to still enjoy a great meal with your chosen chef.
- If you cancel less than 7 days before the scheduled date, unfortunately, we won't be able to offer a refund. However, your chef will still receive the Service Fee established in their proposal, and we'll keep the Management Expenses. We hope you understand that this is necessary to protect our chefs and their livelihoods.

Please note that we reserve the right to assess the legitimacy of refund requests based on the information available.

In the event that a refund applies, we'll retain 3% of the total service cost to cover non-refundable transactional fees.

If you need to make a claim about a contracted service, please contact us within 24 hours of the scheduled execution of the service. We want to make sure we can address any concerns as quickly as possible.

Finally, we want to remind you that you won't have the right of withdrawal from the moment of delivery of the Confirmation of reservation, as long as the Contract between you and TwoTooAte has been executed in its entirety. We're committed to providing you with the best possible experience, and we appreciate your understanding of these policies and procedures.

7. PLATFORM USERS COMMITMENT

Commitment of all visitors to the Platform:

You understand and agree that you are solely responsible for complying with all laws, regulations, and obligations that apply to your use of the Platform.

To ensure a safe and respectful environment for all users, you agree to:

- Not provide false, fraudulent, or misleading information to TwoTooAte or other users of the Platform, particularly when creating or updating your account.
- Not publish, speak, or behave in any manner that is defamatory, offensive, obscene, pornographic, vulgar, aggressive, inappropriate, violent, threatening, harassing, racist, or xenophobic. Your content should not have sexual connotations, incite violence, discrimination, or hatred, or encourage illegal activities. Your content should align with the objectives of the Platform and should not infringe upon the rights of TwoTooAte or any third party.
- Not harm the image and infringe the rights of TwoTooAte, particularly concerning its intellectual property rights.
- Not create more than one account on the Platform and not create an account on behalf of someone else.
- Not attempt to bypass the online booking system of the Platform by sharing contact information with other users to make bookings outside the Platform to avoid paying management fees.
- Not contact other users for any reason other than defining the conditions of the private chef service.
- Not accept or make payments outside the Platform.
- Comply with these General Conditions of Service (GCS) and the Privacy Policy.
-It is imperative that all communication between the chef and client be kept strictly on the platform. Any violation of this protocol will result in an immediate warning, followed by swift removal from the platform. This stringent policy is in place to safeguard the integrity of the platform, as well as to protect both clients and chefs in the event of any issues that may arise.


Commitments of the Chefs:

When using the Platform as a chef, you commit to:

- Respecting all laws, regulations, and codes regarding the activity of a private chef, especially having liability insurance in force at the time of the Service.
- Verifying that your insurance policy covers the services offered in each Offer sent to the Customer.
- Not assuming any risk during the performance of the Service, nor taking any product or substance that may adversely affect your care and due diligence required by the activity of the Service itself.
- Executing the Service as described in the Offer and respecting the times and places agreed with the Guest.
- Using utensils in good condition and complying with all legal regulations in this area, especially those relating to hygiene.
- Using raw materials in perfect condition, which comply with the sanitary requirements demanded by the current legislation applicable to the matter.
- Complying with the legal regulations on food transport, especially those referring to the respect of the cold chain.
- Not sending any Offer to those Requests that you are not going to execute personally.
- Ensuring that Diners can contact you at the telephone number registered in your profile.
- Not having any contraindication or medical incapacity to perform the activity of the Service.
- Behaving appropriately and responsibly during the Service, in accordance with these GCS.

Commitments of Diners:

When using the Platform as a diner, you commit to:

- Communicating any changes or modifications regarding the conditions of service agreed on the Platform to the Chef.
- Ensuring that the Chef can contact you at the telephone number registered in your profile.
- Communicating your identity card or any other document that proves your identity to TwoTooAte or any Chef who requests it.
- Informing the Chef of any relevant information that they should know about the real and personal property that they will have to use/occupy during the Service, especially in the case of countertops, walls, glass, glass-ceramics, or any other equipment that could be damaged during the execution of the Service.
- Providing the Chef with the dishes, glassware, cutlery, and other utensils that are necessary to carry out the Service.
- Waiting for the Chef at least 30 minutes after the appointed time.

If you have made a reservation on behalf of a third party, you guarantee that the third party will comply with these GCS. In case of non-compliance, TwoTooAte reserves the right to suspend your account, limit your access to the Services, or terminate these GTU.

8. ACCOUNT POLICY
At TwoTooAte, we understand that our users value their freedom to choose. That's why we have made it easy for you to terminate your contractual relationships with us at any time without any fees or explanations required. All you need to do is simply head to the "My Account" section and select "Delete Account" whenever you feel the need to do so.

However, in certain circumstances, we may need to take action to protect the safety, integrity, and interests of our Users or third parties. These circumstances may arise if you fail to comply with our CGUs, breach your obligations as a User, or exceed the limits established in Article 4

In such cases, we reserve the right to take necessary measures to protect our community. These measures may include rescinding the CGUs that link you to TwoTooAte immediately and without prior notice, avoiding the publication of or deleting any content that you have published on the Platform, limiting your access and use of the Platform, or temporarily or permanently suspending your Account.

We understand that this may sound strict, but please rest assured that we take these actions only as a last resort and always with the intention of protecting our community. Our ultimate goal is to foster an environment where everyone can enjoy our services safely and responsibly.


9. PERSONAL DATA
When you use TwoTooAte's Platform, your personal information will be collected and processed. By registering and using the Platform, you agree to the processing of your personal data by TwoTooAte as per the Privacy Policy and applicable laws.

10. INTELLECTUAL PROPERTY
The following text pertains to the ownership and usage rights of content published on TwoTooAte. TwoTooAte is the sole owner of all intellectual property rights associated with the Service, its content, and the software and databases that ensure its operation. Users are granted a personal, non-exclusive, and non-transferable right to use the Platform for personal and private use, in accordance with the purpose of the Platform and the CGU.

However, it is strictly prohibited to use or exploit the Platform and its content for any purpose other than that foreseen without prior written consent from TwoTooAte. This includes reproducing, modifying, adapting, distributing, publicly representing, and disseminating the Platform's content, except with the prior express authorization of TwoTooAte. Additionally, decompiling and reverse-engineering the Platform, except for exceptions stipulated by applicable texts, and extracting or attempting to extract a substantial part of the Platform's data using data extraction robots or similar data collection tools are also prohibited.

The User-Developed Content refers to the content and data provided by the User in the context of using the Platform. To provide the Services, Users grant TwoTooAte a non-exclusive license to use this content and data. Users also authorize TwoTooAte to reproduce, represent, adapt, and translate their User-Developed Content for the entire world and the entire duration of their contractual relationship with TwoTooAte. This authorization is given to enable TwoTooAte to distribute the Platform content through the digital network and to offer it to the public in accordance with any communication protocol, especially the Internet and mobile networks.

Users allow TwoTooAte to reproduce all or part of their User-Developed Content in any digital recording medium, known or to be known. TwoTooAte may use any server, hard disk, memory card, or other equivalent medium in any format and through any process, known or to be known, as necessary for any storage, backup, transmission, or download operation related to the Platform's operation and the provision of the Service.

Users also authorize TwoTooAte to adapt and translate their User-Developed Content and reproduce these adaptations in any digital medium, known or to be known, established in the previous paragraph. TwoTooAte may make modifications to the format of User-Developed Content to respect the graphic design of the Platform or to make it technically compatible with their software for subsequent publication through the Platform.

11. TWOTWOATE FUNCTION
We want to make it clear that by using the Platform and accepting these CGUs, you are not entering into a formalized agreement with TwoTooAte. Our role is simply to provide a platform for Users to connect and exchange services.

We understand that our Users are independent individuals who are solely responsible for their own behavior and actions on the Platform. Therefore, we do not exploit, supply, or manage any of the services offered by our Users.

At TwoTooAte, we take our role as intermediaries seriously. While we do not control the validity or legality of Offers sent or received, we are committed to facilitating access to the Platform and creating a welcoming community for all of our Users.

We want to emphasize that our Users, both Chefs and Diners, are responsible for their own actions and conduct during their Service. As intermediaries, we will not be held responsible for any incidents that may occur during a Service.

We believe that the Platform is a great opportunity for Users to connect, share their talents and passions, and create unforgettable gastronomic experiences. We are confident that our Users will use the Platform responsibly and respectfully, and we look forward to seeing the amazing connections and experiences that will come from it.

12. OPERATIONS
At TwoTooAte, we take pride in our commitment to providing uninterrupted access to our Platform. We work around the clock to ensure that our services are available to you 24/7. From time to time, we may need to carry out essential maintenance or updates to enhance your experience, and we will do our best to notify you in advance. We understand that unforeseen technical issues or network restrictions may arise, but rest assured that we will work tirelessly to resolve them as quickly as possible. Additionally, we may occasionally introduce new features or temporarily suspend certain functionalities to improve your overall experience. Please know that we always have your best interests at heart and strive to ensure that our Platform remains reliable, secure, and easy to use.

13. MODIFICATION
While any other documents mentioned on the Platform (such as Frequently Asked Questions) are for your reference only, we want to ensure that our CGUs and the integrated documents provide you with all the necessary information. 

At TwoTooAte, we strive to stay up-to-date with the latest technological and commercial advancements and comply with current legislation. Therefore, we may modify our CGUs to better suit your needs and ensure your satisfaction. Rest assured, any changes made to the CGU will be clearly communicated on the Platform and you will receive a notification before the changes go into effect. At TwoTooAte, we have taken care to draft our CGU in accordance with American legislation. Our goal is to provide a platform that is fair, transparent, and conducive to friendly resolution of any disputes that may arise. If you ever need to submit a claim, we encourage you to take advantage of the American Commission's online dispute resolution platform, which can be accessed easily from the link provided. We believe that this is a great resource that can help you resolve any issues quickly and effectively. And if you do need to request arbitration, we ask that you please let us know in writing first so that we can work together to find a solution that works for everyone.
